The mobile application (the "App") is a technology-based platform operated by the Company for the purpose of facilitating access to information, tools, features, and chauffeur-driven transportation services operated by the Company using its own or controlled fleet of vehicles and chauffeurs employed or engaged by the Company, together with any ancillary services, content, offers, or experiences that may be made available through the App. From time to time, the App may also facilitate access to or integrations with independent third-party service providers, partners, vendors, or participants (including payment gateways, map and communication providers, in-car content providers, and brand partners, as applicable).
To the extent the App surfaces, facilitates, or enables any third-party services, transactions, engagements, or arrangements, such interactions are entered into directly and independently between you and the relevant third party. Those third-party engagements are strictly bilateral in nature, and the Company is not a party to, and does not assume any responsibility or liability arising out of, such third-party arrangements.
While the Company endeavours to maintain high standards of safety, training, and service quality for its chauffeur-driven transportation services, transportation inherently involves risks. The Company makes no representations or warranties, express or implied, regarding the accuracy, completeness, reliability, quality, safety (beyond what is mandated by applicable law), legality, suitability, availability, timeliness, or outcomes of any information, content, third-party services, or activities accessed through the App. Without prejudice to the limitations and exclusions of liability set out elsewhere in these Terms, the Company expressly disclaims, to the maximum extent permitted by applicable law, any liability for acts, omissions, negligence, misconduct, delays, failures, deficiencies, or defaults of any third party, including third-party service providers, payment gateways, network operators, or content providers.
Use of the App and reliance on any information, content, or services accessed through it is entirely at the user's own discretion and risk. To the maximum extent permitted under applicable law, including the Indian Contract Act, 1872 and the Information Technology Act, 2000, the Company shall not be liable for any indirect, incidental, consequential, special, punitive, or economic losses, including loss of profits, loss of data, loss of opportunity, or business interruption, arising out of or in connection with the use of the App or any services or integrations made available thereon, and any direct liability of the Company shall be subject to the limitations set out in these Terms.
Nothing contained in these Terms of Use shall exclude or limit liability to the extent such exclusion or limitation is prohibited under applicable law.
